Comparative Administrative Law

Michael has written a number of articles and book chapters in the field of comparative administrative law.  He recently  published  “Ex Ante Administrative Review of the Legality of Regulations: A Comparative Approach,” 68 American Journal of Comparative Law 332 (2020).  This article concerned a system whereby an independent government agency reviews the legality of regulations adopted by different agencies before the regulations are subject to judicial review.  Versions of this institution exist in California, Israel, France and Chile. Michael’s co-authors were Yoav Dotan, Marie Cirotteau, Thomas Perroud, and Gabriel Bocksang Hola

Michael also published “A Comparative Approach to Administrative Adjudication” which is chapter 28 in the Oxford Handbook of Comparative Administrative Law (2021).  The Oxford chapter was inspired by his earlier work on comparative adjudication “Five Models of Administrative Adjudication,” 63 American Journal of Comparative Law 3 (2015).

Michael and Yoav Dotan published two comparative administrative law articles about the U.S. and Israel.  “Hired Guns and Ministers of Justice: The Role of Government Attorneys in the US and Israel,” 49 Israel L. Review 3 (2016) and “Open and Closed Judicial Review of Agency Action: The Conflicting US and Israeli Approaches,” 64 American Journal of Comparative Law 521 (2016).
